These conditions apply to use of the Miss Maud Gift Card:

Miss Maud Gift Card issued by Town Inn Pty Ltd ABN 94008712963 trading as Miss Maud.

In these Terms and Conditions, "gift card" refers to Miss Maud gift cards; “we, us, our” refer  to Miss Maud, as indicated on the gift card you hold.  

Miss Maud may, in its complete discretion, refuse to sell gift cards to any person at any time for any reason.

Purchasing or using the gift card means that you accept the terms and conditions of this agreement. If you let another person use your gift card, you must tell them that they will be bound by these terms and conditions.

WA law applies to this agreement. By entering into this agreement you unconditionally submit to the jurisdiction of the courts of WA.

1. Upon activation, gift cards become subject to the Terms and Conditions relating to gift card use,  which are available at missmaud.com.au.
    
2. Gift cards may be used to purchase goods or services at any Miss Maud store in Western Australia with operating “EFTPOS” facilities, when the gift card has sufficient unused value to make the purchase.   A list of Miss Maud locations is available online at missmaud.com.au/pastryhouse.
    
3. Gift cards cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new gift card, or be replaced after expiry.  Gift cards are not legal tender, account cards, credit or debit cards or securities.
    
4. Keep your gift card secure and treat it as you would treat cash, anyone holding the gift card can use its value to make purchases.  
    
5. We may cancel any gift card, or the gift card scheme, for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card.  
    
6. We can vary or replace these conditions from time to time. The current version of these conditions is available through our contact channels.
    
7. If you have a query or complaint about the gift card, please raise it with our Service Centre, Monday to Friday, 9.00am to 5.00pm, 9328 9611.

IMPORTANT – VALIDITY: MISS MAUD GIFT CARDS EXPIRE THREE YEARS AFTER THE DATE OF ISSUE
Gift cards are valid for three years from the Date of Issue. After the gift card has expired, it is no longer valid and all transactions will be declined. Unused value will not be refunded and will become our property.

By placing an order for purchase of gift cards via this website ("Order") you are agreeing to the terms conditions set out below. 

ORDERS

1. You may place an online gift card order by selecting Gift Ideas from the homepage at missmaud.com.au, then choose Gift Card
    
2. An online gift card orders will be deemed to have been received by Miss Maud at the time Miss Maud staff contacts you to confirm details.
    
3. Once accepted, each order represents a separate Agreement incorporating the terms of that Order, including these terms and conditions.
    
4. All deliveries are subject to approval of online payment. 
    
5. Orders for gift cards placed on business days between the hours of 9am-3pm (Australian WST) are generally processed within 24 hours.  Purchases outside these hours, eg weekends or public holidays, may take up to 48 hours to process.
    
6. A minimum value of $10 and a maximum of $500 can be loaded on each Gift Card.  You may place an Order for up to 50 Gift Cards in one Order, with a total value not exceeding $10,000.  We may change the minimum and maximum amounts that can be loaded onto a Gift Card from time to time at our sole discretion. To purchase more than 50 Gift Cards or a total value exceeding $10,000 in value please contact our Service Centre on 9328 9611.
    
7. Miss Maud reserves the right to not accept online gift card orders, including those requesting commercial quantities of gift cards. If Miss Maud is unable to supply your total gift card order a staff member will endeavour to contact you to discuss whether you wish to proceed with the part of the gift card order.
    
8. Miss Maud reserves the right to cancel any online gift card order at any time, without notice, for any reason.
    
9. In event of a cancelled online gift card order, any payments processed by Miss Maud will be promptly refunded.
    
10. Customers who wish to cancel an online gift card order must immediately notify Miss Maud on 9328 9611 during business hours. Gift card orders that have already been processed cannot be cancelled.  Miss Maud will endeavour to process a cancellation request where possible, but will not be liable for any failure to do so.
     

PAYMENT OF ONLINE GIFT CARD ORDERS

1. Payment for online gift card orders is to be made by Visa, MasterCard, American Express or Miss Maud Corporate Account only.  Our staff member will phone you to finalise the purchase process.
    
2. Miss Maud will then process payment for your online gift card order, plus any postage charges.
    
3. You authorise Miss Maud to debit the Total Amount from your nominated charge or credit card.
    
4. If your nominated charge or credit card is declined by your financial institution, Miss Maud will not be required to fulfil the online gift card order, and may contact you to make alternative payment and delivery arrangements.
    
5. Miss Maud may decide at any time not to accept payment from you by charge or credit card for any reason. If we decline to accept payment, we will not process the online gift card order and may not contact you to inform you that your online gift card order will not be processed.

GIFT CARD DELIVERY

1. Gift Cards can only be delivered within Australia.
    
2. All online gift card orders are shipped via Express Post using the services of Australia Post to a nominated residential or business address at an additional charge.  Miss Maud will not be responsible for late delivery due to postal delays or incorrect or incomplete delivery of payment information submitted by the purchaser, .  If you have not received your order withn 7 days please contact us directly on 9328 9611.
    
3. Miss Maud will not be liable to you or anyone else for any losses suffered or incurred due to delay in delivery or for any lost or misdirected gift cards, including any gift cards lost or misdirected in the mail.
    
4. Subject to payment, property and risk in the gift cards passes to you upon dispatch of the gift cards to your nominated delivery address.

CORPORATE GIFT CARD ORDERS

Please contact Miss Maud Service Centre to discuss your corporate Miss Maud Gift Card requirements, 9328 9611.

Orange background vouchers issued prior to December 2012 had no expiry date, and will still be honoured by Miss Maud, subject to the following:

• Not valid without cash register imprint
• Vouchers can be used towards the purchase of goods at any Miss Maud outlet
• Vouchers cannot be exchanged for cash

Please check the reverse of your gift voucher for validity details.

Miss Maud may at any time revise these Terms of Use and you agree to comply with the Terms of Use as varied from time to time.

We do not give any guarantee or warranty of make any representation of any kind, express or implied, with respect to use of our website.   Other than those that cannot be excluded by law, we exclude all conditions and warranties implied by custom, law or statute.

We do not warrant that the functions contained in any material or your access to our website will be uninterrupted or error-free, that any defects will be corrected or that our website or the server which stores and transmits materials to you are free of viruses or any other harmful components.

We do not warrant or make any representation regarding your access to, or the results of your access to, our website or any material in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.

Under no circumstances (including but not limited to any act or omission on our part) will we or our officers, employees, agents, contractors and related entities be liable for any direct, indirect, incidental, special and/or consequential damagees, loss, claim, expense or loss of profits whatsoever which results from any use or access, or any inability to use or access, or misuse by you or any othe rparty, or interference with or damage to your computer systems in connection with the use of our website or otherwise in connection with any material.

All material on our website is protected by copyright and other intellectural property rights, whether registered or unregistered.  The copyright is owned by us.  You may use the website only for your personal and non-commercial purposes.  No material contained on the website may be modified, copied, transmitted, distributed or reproduced without our prior written approval.  You must not use the website in any manner or for any purpose which is unlawful or in any manner which violates any of our rights or which is prohibited by these Terms of Use.

Our Service may contain links to external sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy and terms and conditions of every site you visit.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites, products or services.

We take steps to ensure that the personal information we collect is accurate, up to date and complete as required.  These steps including maintaining and updating personal information when it is advised by customers that their personal information has changed, and at other times as necessary.
